Oregon Supreme Court to hear challenge to ballot measure punishing senators who walked out - KATU

The Oregon Supreme Court will hear the case of five Republican lawmakers who believe they should be allowed to run for reelection in 2024 despite a voter-approved ballot measure that was meant to bar them from doing so.

The lawsuit was filed by Republican Minority Leader Tim Knopp and state Sens. Daniel Bonham, Suzanne Weber, Dennis Linthicum, and Lynn Findley. But ultimately 10 lawmakers that racked up 10 or more absences during the six-week quorum-denying walkout would be impacted by the ruling.

The Republican senators' challenge is based on wording in Ballot Measure 113 that calls for lawmakers with 10 or more unexcused absences to be barred from running in the election following the end of their current term. Because their term ends after the 2024 election, the senators claim they should be allowed to run for another term.

Oregon Secretary of State LaVonne Griffin-Valade has stated she intends to interpret the wording of the measure based on its intention and to bar lawmakers who ran afoul of the measure's allotted absences from running in 2024.

In the interest of resolving the issue prior to candidacy deadlines, both the state, represented by the Office of the Attorney General, and the Republican senators, agreed to expedite the process and requested that the challenge skip the Appellate Court and go straight to the Oregon Supreme Court.

Leaders of both parties declined an interview as did the DOJ and the Secretary of State's Office.

Knopp has said that all Republican senators that risk being barred from reelection in 2024 will endorse a substitute just in case.

Sen. Dennis Linthicum has already done so, endorsing his wife Diane Linthicum who filed in September.

The state's legal arguments in defense of Measure 113 are due Friday. Republicans will need to respond by Nov. 3 The trial begins Dec. 14.
