COLUMBIA, Mo. (KMIZ)

A Boone County judge could rule on several motions to dismiss a lawsuit against a former University of Missouri fraternity over a pledge's hospitalization from alcohol poisoning.

Judge Joshua Devine is expected to hear the motions filed by six defendants at a hearing scheduled for 2:30 p.m. May 10 in the lawsuit against Phi Gamma Delta.

The family of Danny Santulli filed a lawsuit against Phi Gamma Delta, also known as FIJI, in late January after he suffered from alcohol poisoning in October 2021.

The family claims the Mizzou chapter of the fraternity made their freshman son drink a bottle of vodka in order to join. In late February, the Santullis' attorney told ABC 17 News that Danny was still recovering from alcohol poisoning.

The University of Missouri revoked Phi Gamma Delta's recognition in October.
