FLINT, MI — The Michigan Supreme Court has decided not to hear an appeal from the City of Flint in a lawsuit over claims the city improperly raised its water rates.

“On order of the Court, the application for leave to appeal the April 16, 2020, judgment of the Court of Appeals is considered, and it is denied, because we are not persuaded that the questions presented should be reviewed by this Court,” the Supreme Court stated in a brief, Tuesday, Dec. 22 ruling.

The Court of Appeals had ruled a lower court erred in some decisions and remanded the lawsuit for a new trial, prompting the city to file an application for leave to appeal with the Supreme Court.

The original lawsuit was filed in 2012 against the City of Flint by former city council president Scott Kincaid, claiming the city didn’t follow its policy for raising water and sewer rates by 35 percent and improperly spent the funds it collected.
