
COLUMBUS, Ohio - The Ohio Supreme Court will hear a case next week over whether to release footage of the 2017 shooting of Jefferson County Common Pleas Court Judge Joseph Bruzzese Jr.
While walking to work on Aug. 21, 2017, Bruzzese was shot by Nate Richmond outside the county courthouse in Steubenville. Judge Bruzzese and a nearby probation officer returned fire at Richmond, who was killed. The judge was hospitalized. Andrew Welsh-Huggins, a Columbus-based reporter for the Associated Press, requested a copy of the video recording of the shooting from the Jefferson County prosecutor, who denied the request.
The AP filed a complaint in May 2018 against the prosecutor in the Ohio Court of Claims, which handles public records disputes in a streamlined process that the legislature created in 2016.
The AP contends that the prosecutor didn’t successfully argue the video is a security record, which would exempt it from public disclosure.
After a failed mediation, the Court of Claim’s special master assigned to the case asked the prosecutor for additional information.
The prosecutor submitted an affidavit, or a written statement under oath, and a sealed copy of the video. In response to two subsequent requests for information, the prosecutor provided several still photos and two more affidavits.
In January 2019, the special master ordered the release of the video, writing that the prosecutor didn’t meet the burden to show the video was exempt from public disclosure.
The prosecutor appealed to the Seventh District Court of Appeals, which ultimately concluded the video is exempt from disclosure -- although it noted the prosecutor’s affidavits were not from the court’s security office.
The AP appealed to the Ohio Supreme Court, which has accepted the case. Oral arguments will be through video conferencing on Tuesday. The public can watch on the Ohio Channel.
Richmond was the father of Ma’Lik Richmond. Ma’Lik served about 10 months in a juvenile lockup after being convicted with another Steubenville High School football player of raping a 16-year-old girl during an alcohol-fueled party in 2012. The case brought international attention to the city across the Ohio River from West Virginia.
The Intelligencer and Wheeling News-Register in West Virginia reported at the time that Bruzzese was overseeing a wrongful death case that Richmond filed against a housing authority over a fire that killed Richmond’s mother and a toddler.
